Terms of Service

These Terms of Service govern your use of services provided by XGS Hosting, including game server hosting, bot hosting, web hosting, VPS services, related support, and any control panels or billing systems we make available.

1. Agreement

By ordering, accessing, or using our services, you agree to these Terms of Service, our Privacy Policy, and our Acceptable Use Policy. If you are using the service on behalf of a business or organization, you represent that you have authority to bind that entity to these terms.

2. Services

We provide hosted infrastructure and related management tools. Unless we explicitly state otherwise in writing, we do not guarantee that any service is suitable for a particular game, bot, workload, revenue use case, or third-party software configuration.

Service specifications, resource allocations, locations, pricing, and included features may change from time to time. We may also suspend, modify, or discontinue a service offering where required for operational, security, abuse-prevention, legal, or business reasons.

3. Eligibility and account security

You must provide accurate account, billing, and contact information and keep it current. You are responsible for all activity under your account, including activity by any sub-users, employees, friends, moderators, or anyone you give access to.

You must keep your login credentials, API keys, tokens, panel access, and payment information secure. If you believe your account has been compromised, you must notify us immediately at support@xgshosting.com.

4. Billing and renewals

Services are billed in advance on the billing cycle shown at checkout. Unless a product explicitly states otherwise, services automatically renew at the end of each billing period using your active payment method or your account balance.

You authorize us to invoice and collect all recurring fees, overages, taxes, chargeback fees, dispute fees, and other amounts owed in connection with your account. Failure to pay by the due date may result in late notices, suspension, termination, service deletion, or all of the above.

5. Refunds

Unless a specific refund guarantee is clearly advertised for a product, all payments are non-refundable. Setup fees, custom services, add-ons, domain-related fees, software licenses, and payments reversed due to abuse or policy violations are not refundable.

If we choose to issue a courtesy refund, that does not create an ongoing obligation to issue future refunds in similar situations. Chargebacks or payment disputes may result in immediate suspension or termination of all active services on the account.

6. Customer content and responsibility

You are solely responsible for all files, data, software, server activity, communications, and content hosted, transmitted, processed, linked, or made available through your service. You are also responsible for ensuring that your use of the services complies with all applicable laws, regulations, contracts, and third-party terms.

We provide infrastructure. We do not pre-approve, actively monitor, or endorse your content. Even where content appears legal on its face, we reserve the right to review, restrict, suspend, or remove services that create network risk, abuse risk, legal exposure, repeated complaints, or operational instability.

7. Prohibited conduct

  • Using the services for illegal content, fraud, phishing, scams, malware, ransomware, unauthorized intrusion, credential theft, or deceptive activity.
  • Sending spam, running abusive automation, launching denial-of-service activity, port scanning without authorization, or interfering with other networks, users, or services.
  • Hosting content that infringes intellectual property rights, violates privacy or publicity rights, or breaches contractual or legal duties.
  • Using excessive resources in a way that degrades node stability or materially affects other customers, unless that usage is covered by the purchased service.
  • Attempting to evade suspensions, abuse investigations, payment holds, or security controls.

8. Suspensions and terminations

We may suspend, restrict, or terminate any service or account immediately, with or without notice, if we believe there is a violation of these terms, the Acceptable Use Policy, the law, payment obligations, third-party rights, or the security and stability of our systems.

We may also suspend services for maintenance, emergency mitigation, abuse handling, chargeback investigations, or requests from law enforcement or upstream providers. Where practical, we may provide notice, but we are not required to do so before acting.

9. Backups and data loss

You are responsible for maintaining your own current backups unless a managed backup feature is expressly included in your plan. Even if we offer snapshots, backups, or restore tools, you should assume that no backup system is guaranteed, complete, or available at all times.

We are not liable for data loss, corruption, deletion, failed restores, third-party software issues, or downtime caused by your configuration, your software, upstream network events, attacks, or force majeure.

10. Uptime and support

Any uptime targets, provisioning times, or support response estimates shown on our site are goals or service descriptions unless separately stated in a signed service level agreement. We do not guarantee uninterrupted availability, exact response times, or compatibility with every plugin, mod, panel, dependency, or custom workload.

Support is limited to the scope of the purchased service. We may decline requests involving unsupported software, code debugging, custom development, heavily modified deployments, or issues caused by third-party content and user error.

11. Intellectual property

You retain ownership of the content you lawfully own and upload to the services. You grant us a limited license to host, transmit, cache, back up, and process that content as needed to provide the services and protect the platform.

All rights in our site, branding, control panels, documentation, systems, and related materials remain with XGS Hosting or our licensors. You may not copy, resell, reverse engineer, or misuse our services except as permitted by law and these terms.

12. Disclaimer of warranties

Services are provided on an "as is" and "as available" basis. To the maximum extent permitted by law, we disclaim all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, and any warranty arising from course of dealing or usage of trade.

13. Limitation of liability

To the maximum extent permitted by law, XGS Hosting will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenue, goodwill, use, or data, even if advised of the possibility of such damages.

Our total aggregate liability for any claim relating to the services will not exceed the amount you paid to us for the affected service during the three months immediately preceding the event giving rise to the claim.

14. Indemnification

You agree to defend, indemnify, and hold harmless XGS Hosting and its owners, staff, contractors, and providers from claims, damages, liabilities, fines, losses, and expenses arising out of your use of the services, your content, your customers, or your breach of these terms.

15. Governing law

These terms are governed by the laws of the State of Maine, without regard to conflict-of-law rules. Any dispute arising from these terms or the services must be brought in a court of competent jurisdiction located in Maine, unless applicable law requires otherwise.

16. Changes to these terms

We may update these terms at any time by posting a revised version on our site. Your continued use of the services after the effective date of the revised terms constitutes acceptance of the updated terms.
